Island Mobility are based at 32/34 Dodnor Lane, Newport, Isle of Wight, PO30 5XA. Island Mobility Limited will only provide and maintain equipment to clients based on the island. We may not be able to support equipment that we have not supplied.
In these conditions “the Company” means Island Mobility Limited. “the Customer” means the person, firm or Company who receives the Company’s goods, services or whom the Company’s quotation, invoice or acknowledgement of order is addressed; “the goods” means the products supplied by the Company to the Customer.
(a) Prices contained in a price list / quotation / catalogues, etc.… are those ruling at the date thereof and are for guidance only. The Company reserves the right to adjust the quoted prices to the prices current on the date of dispatch. All prices are subject to VAT at ruling rate. If the product and the client are eligible for VAT relief we have the appropriate forms that will be required to be completed.
(b) Price Fluctuation: The price and terms are based on conditions ruling at the date thereof and are subject to alteration at any time.
(c) The cost of carriage and packaging if required by the Customer shall unless otherwise stated be charged extra.
3. Terms of Payment
(a) Payment of invoice is due upon receipt of goods.
(b) Business account holders are strictly net within 30 days following date of the invoice.
(c) Payment is accepted by credit/debit card, cash, cheque or bacs, our bank details can be found below and at the bottom of our invoices. For special orders placed a non-refundable deposit is due at point of order.

(d) Failure by the customer to pay in accordance with the terms of the contract shall entitle the Company as its options to: (i) withhold future dealings and until such payment has been made and: (ii) charge interest at 3% above Santander base rate for each day the amount remains outstanding after the due date.
a. Any dates quoted for delivery are approximate only; the Company will endeavor to deliver the goods as arranged with the Customer but this cannot be guaranteed. We will contact you when the item is available to book a convenient delivery date. The Customer shall not be entitled to cancel the order or to claim damages if the delivery is delayed due to circumstances beyond our control. The company is unable to schedule deliveries for a specific time of day.
b. Alterations to the order by the Customer may result in delay in delivery.
c. The Company will endeavor to comply with reasonable requests by the Customer for postponement of delivery but shall be under no obligation to do so and may charge the Customer with reasonable charges for storage.
d.It is the responsibility of the customer to ensure there is clear and sufficient access to the property to take receipt of the goods.
e. If special arrangements for moving or removing furniture is required, the company must be notified beforehand and will be subject to a special charge.
5. Passing of Title in Property
(a) Ownership of the goods supplied shall not pass to the Customer until all monies owing to the Company in respect of such goods have been paid to the Company in full.
(b) The responsibility of the goods shall pass to the Customer upon delivery. The Company will not be liable to the Customer for any loss or damage to the goods occurring after delivery to the Customer.
a. This warranty does not affect the statutory rights of the Customer but if the Customer wishes to have the benefit of the Company’s warranty conditions the Customer must comply with the provisions set out below.
b.In the event of a defect in the goods supplied becoming apparent within the warranty period which commences from the delivery date the Company either itself or by an authorised dealer/repair agent will affect any necessary repair or replacement of parts free of charge on condition that the Customer complies with the
following provisions of this warranty.
c. Any part repaired or replaced during the warranty period is warranted for the duration of that period.
d. The arrangements for repairs and service and the designated repairer will be notified to the Customer by the Company and will be confirmed at any time on request.
e. ON A DEFECT OCCURING DURING THE WARRANTY PERIOD THE CUSTOMER MUST NOTIFY THE DESIGNATED REPAIRER IMMEDIATELY GIVING FULL INFORMATION AS TO THE PROBLEM AND NO USE MUST BE MADE OF THE GOODS AND NO ALTERATION OR UNAUTHORISED REPAIRS MADE TO THE GOODS PRIOR TO INSPECTION BY THE DESIGNATED REPAIRER.
f. Items of a consumable nature will not normally be covered during the warranty period unless such items have suffered undue wear as a direct result of an original manufacturing defect. These items include amongst others lubricants, motor brushes, upholstery, tyres, inner tubes, brakes and similar parts. Batteries will be covered by the warranty only where they have been charged and maintained fully in accordance with the manufacturer’s recommendations.
g. Under normal circumstances, no responsibility will be accepted where the goods have required repair or replacement as a direct result of:-
1) The goods or part not having been maintained in accordance with the manufacturer’s recommendations, where such exist and using only the specified original equipment parts.
2) The goods or part having been damaged by neglect, accident or improper use.
3) The goods or part having been altered from the manufacturer’s specifications, or repairs having been attempted prior to the designated repairer being notified.
4) Fair wear and tear.
7. Cancellation or Variation
(a) . Cancellation will only be agreed to by the Company on condition that it’s received within the fourteen day cancellation period. In the case of special orders the cancellation will result in the loss of the deposit.
(b) In the event of the Customer altering the requirements of the contract after instructions have been received by the Company the Company reserves the right to amend the delivery time and to charge for any costs incurred as a result of the alteration. Goods made to special order cannot be cancelled.
(c) The cancellation of special orders will result in the customer foregoing their non-refundable deposit.
(d) If you purchase a product from the company in your own home and you wish to cancel you must notify the company 14 days from the day after receipt of the goods.
8. Force Majeure
The Company will make every effort to carry out the Contract in accordance with its terms but it shall not be liable for any failure on its part to perform any term of the contract from any cause outside the Company’s control including (but without prejudice to the generality of the foregoing) act of God, war, strike, lock-out or other industrial dispute, fire or flood
9. Law and Interpretation
This contract shall be governed by English law and the buyer shall submit to the non-exclusive jurisdiction of the English Courts. If any of these conditions or any part thereof is rendered void or unenforceable by any legislation to which it is subject or by any rule of law it shall be void or unenforceable to that extent and no further.
The Company does not warrant or guarantee that the goods will be fit for the Customers specific purpose unless exact details of such purpose have been notified in writing to the Company’s order. The Company will, at its option, repair or replace with a comparable type or size, any defective product or component without charge upon notification, examination and confirmation of the defect. This warranty applies only to manufacturing defects and does not apply to damage caused by abuse, misuse or any other type of damage. Consequential damages, including water damage are excluded.
11. No verbal agreement shall be binding unless confirmed in writing.
12. Our returns policy
a. Regrettably, once products have been delivered to you and any statutory cooling off period has expired, no products will be accepted for return other than (a) in our absolute discretion or (b) where such products are damaged or defective.
b. Every effort will be made to ensure that the products that you have ordered arrive undamaged and without defect.
c. If the products are found to be either damaged or defective in any way at the time of delivery, you must state this on the delivery note which will be provided by our delivery team. If such damage or defect is discovered after delivery, you must contact us within three days of delivery of the product or, in the event of a latent defect, within three days of the date upon which you discovered the defect.
d. Upon receipt of notification of alleged damage or defect from you, we will arrange to inspect the product concerned. You must not make any use of it, not make any alteration to it nor return it or arrange for its return before we have been provided with the opportunity to inspect and investigate.
e. If upon inspection we agree that the item is damaged or defective and we are unable to repair the item to manufacturing standards, we will arrange for collection of the item and we will then contact you to arrange delivery of a replacement item to you as soon as replacement stock is available and/or offer you a full refund (including delivery charges). We are only able to hold such replacement stock for a reasonable period and reserve the right to levy a restocking charge in circumstances where you are unable or unwilling to accept such delivery within a reasonable time.
f. If as a result of and inspection, we determine that we have no legal liability in respect of the matters complained of, then we reserve the right to levy our standard call out charge and to reject any claim in respect of alleged damaged or defective products.
g. Once unwrapped or unboxed mattresses and personal hygiene products are excluded from our returns policy for health and hygiene reasons.
h. Please note the following product information which forms part of our Returns Policy
h, 1. Surface fillings of mattresses may flatten. This is called dipping or settlement and is normal with use.
h,2. Furniture manufactured from natural materials e.g. wood or leather will all have an individual appearance and may have a slight variance in colour and texture. This adds to the individuality and character of each item manufactured.
h,3. Leather furniture will display natural characteristics such as scarring and variations in grain. In the cases of semi-aniline and aniline leathers, there will also be colour variations.
i. If the goods have been used or damaged any refund given will be reduced to take this into account
